Transfer - Registered Owners Screen


On the Confirm Owners screen you have already selected the current registered owner(s) of the folio(s) being transferred.  You are now asked to confirm whether each of those owners is taking part in this transfer.

IF the registered owner IS taking part in the transfer, alongside each owner name shown, selecting ‘Yes’ indicates that the owner is taking part in the transfer.  You will then be asked the following questions:

  • Is this a full or limited owner?  If in doubt, view an up-to-date version of the folio record to confirm.  If any of the registered owners taking part in the transfer ARE limited owners, the system will produce a Form 10 or Form 11 (if any easements/burdens are added)
  • Is the Remainderman joining in the transfer?  This question is only displayed if you have already entered details of one or more Remaindermen on the Non Registered Owners screen.  If more than one Remainderman has been recorded, you will be asked to select which are joining in with this registered owner.
  • Is the registered owner to join in to acknowledge receipt of the transfer consideration?  This question is only displayed if you have already entered details of one or more Trustees Under the Settled Land Acts on the Non Registered Owners screen.  Answering ‘Yes’ here will include the details of this owner alongside the Trustee details in Panel G of the Transfer form generated for this transaction.

 

IF the registered owner IS NOT taking part in the transfer:  Alongside each owner name shown, selecting ‘No’ indicates that the owner is not taking part in the transfer.   You will then be asked why the owner is not taking part in the transfer.  A dropdown list offers reasons for non-participation in the transfer. This list will always contain at least three available options:

  • Death of Joint Tenant
  • Owner is a Tenant in Common not transferring their share
  • Other (allowing you to enter the reason for non-participation using free text)

If you have created any non-registered owners on the Non Registered Owners  screen, you will also be able to indicate that a non-registered owner is acting instead of this person.  If you have previously indicated that a Controller, Liquidator, Administrator, Receiver, Personal Representative or Trustee in Bankruptcy is taking part, you must use this screen to select the owner(s) on whose behalf they are acting.


If “Death of Joint Tenant” is selected as a reason, the following precedent must be submitted along with the Death Certificate.

4.I request that the ownership of the said AB be cancelled and that the said CD and EF be registered as full owners of the land in the above-mentioned folio.
