Death of a Joint Tenant

An application to note the death of a registered owner who was a joint tenant may be made by way of a solicitor’s certificate (Rule 47). The documents to be lodged in the Registry are:

(i) the certificate (Precedent 4.C);
(ii) the deceased’s death certificate or a Grant of Representation in his estate;
(iii) the Land Certificate

  1. AB, one of the above-named registered owners died on ..........
  2. The other registered owners CD and EF are still alive.
  3. The joint tenancy had not been severed prior to AB’s death.
  4. I request that the ownership of the said AB be cancelled and that the said CD and EF be registered as full owners of the land in the above-mentioned folio.
