Bankruptcy Inhibition

Bankruptcy Inhibition/Order

When a bankruptcy petition is presented against a registered owner, the Bankruptcy Office should lodge a notice of petition for registration (Form 76). When, subsequently, a bankruptcy order is made, the Official Receiver or Trustee in Bankruptcy should lodge a notice in LR Form 78 (Precedent 10.A) in accordance with Rule 155. Production of the Land Certificate is not essential. Upon receipt of this notice the Registrar will enter a bankruptcy inhibition on the folio to protect the rights of creditors.
