Guide to Transfer and Transfer of Part

The following steps are involved in providing the information for the Transfer/Transfer of Part transaction:

Introduction screen: confirming that the online system supports your transaction.

Select Folio(s) screen: allowing you to select the folio(s) to be transferred, with a link to search for additional folios.

Confirm Owner(s) screen: requires you to confirm the current registered owner(s) for each folio you are using in the transfer. At this stage you are not indicating whether each person is taking part in the transfer or not, simply that you agree they are current owners for the purpose of this transaction.  Also allows the addition of extra names (to be used where a folio is in draft and does not have any registered owners recorded).

Non-Registered Owners screen: catering for the following non registered owner types: Controller, Liquidator, Administrator, Receiver, Mortgagee in Possession, Official Receiver, Trustee in Bankruptcy, Personal Representatives, Trustees under the Settled Land Acts, Remaindermen. This is not intended to capture details of any Non-Registered Owners joining in the transfer to release an interest in the land, such as owners of Inhibitions or Charges.  These are handled in a later transfer screen, Interested Parties.

Registered Owners screen: confirming whether each registered owner of the folio(s) involved in transferring the land, and capturing additional information relating to Power of Attorney, limited company/LLP status.  

Transferee Details screen:  identifying the transferee name(s) and address(es), plus additional information on whether the transferee is a minor, an existing registered owner of folio(s) involved in the transfer, and whether they will be signing the deed.

Ownership screen: identifying full/limited ownership details for each transferee, plus how the land is to be owned (Joint Tenants/Tenants in Common) where more than one transferee is to be registered.

Settlement Details screen: capturing any Settlement details to be shown on the form.  This screen is only displayed if one or more applicants is to be a limited owner.

Transfer Consideration screen: requiring the selection of the consideration type and the market value/consideration of the transfer.

Land Description screen: for each folio included in the transfer, you must indicate how the land is being transferred (all of the land in the folio, the residue of the land in a folio already part transferred in another transaction in this case folder, part of the land in the folio, or  ‘No transfer’ where ownership of the folio is not being transferred and the folio is included only for the purpose of recording Rights, Covenants or Agreements.

Transfer of Part screen: this screen is only displayed if one or more folios are being part transferred, and advises you of the new folio(s) to be created by the transfer.  If one or more freehold folios are being part transferred, a new freehold folio will be created when you submit the Case Folder to Land Registry.  If one or more leasehold folios are being part transferred, a new leasehold folio will be created when you submit the Case Folder to Land Registry.

Easements screen:  offers the option to enter details of easements or covenants using the system, and these will appear printed on the Form 11.  Alternatively, if your application relates to a new housing development where you may be obliged to accept the developers form of easements and covenants, you may opt to attach your own documents to the Form 11 generated by the system.

Interested Parties screen: capturing details of any Non-Registered Owners joining in the transfer to release an interest in the land, such as owners of Inhibitions or Charges.

Stamp Duty screen: determining the status of this transaction for Stamp Duty purposes and determining the document required.

Execution Panel screen: displaying the clauses to be shown on the Execution Panel of the Deed.  You may choose to amend the information shown on this screen, to cater for execution by Company Seal or Authorised Signatories, or where the deed will be executed by a signatory acting under Power of Attorney, or under direction from an entitled party. 

Form Complete screen:  highlighting any errors on the screens, if applicable. If the information has been successfully completed, you will progress to the Case Folder Detail screen and may then create the Form 9/10/11 for the transaction.
