Transfer - Easements

If the transfer of the land creates new easements or covenants requiring registration, Form 11 will be generated for this transaction.  

You will be offered the option to enter details of easements or covenants using the system, and these will appear printed on the Form 11.  Alternatively, if your application relates to a new housing development where you may be obliged to accept the developers form of easements and covenants, you may opt to attach your own documents to the Form 11 generated by the system.


If you choose to use the system to display Easements, you will pass through five screens:

  • Schedule One - Rights Granted
  • Schedule Two - Exceptions and Reservations
  • Schedule Three - Covenants by Transferor
  • Schedule Three - Covenants by Transferee
  • Schedule Three - Mutual Agreements

On each screen, if more than one right/exception/covenant is to be recorded, ensure these are clearly labelled; e.g. 1), 2), 3) or a), b), c).

For Schedule Three information, if any covenants/agreements require registration, use the second text area to list the reference(s) of the item(s) requiring registration (use a comma ',' to separate the references).

If any mappable rights are to be added, your application must be accompanied by an approved map.

 
If you wish to attach your own Easement document(s) to the Form 11, you will bypass the screens allowing entry of Easement Details, but a Form 11 will be produced when you generate the form upon completion.
You must ensure that the relevant easement forms are attached to the Form 11 before you submit your application to the registry.
